Judge denies Apple rescheduling motion

Apple's request to rearrange the schedule of post-trial hearings against Samsung has been denied in court.

Presiding Judge Lucy Koh issued an order denying the request allowing Samsung to dispute their existing Galaxy Tablet ban before their appeal to overrule the jury's original decision.

The world's most valuable company is currently seeking a permanent sales ban on eight Samsung devices, as the South Korean firm tries to dissolve an existing injunction against its Galaxy Tab 10.1.

Judge Koh last week consolidated Apple's permanent injunction motion scheduling the hearing for December 6, with Samsung's motion to dissolve switched to September 20.

Yet Apple disputes the new dates as it believes the dissolving of the Galaxy Tab injunction can still be overturned, equating to combine the permanent sales ban hearing with the motion to dissolve at the pre-Christmas date.

Yet the court denied the request, saying: "The Court finds good cause for setting different briefing and hearing schedules for the parties' respective injunction-related motions."
